Distance Sales Agreement and Preliminary Information Form.

Preliminary information and contract terms for the sale of MEGAWATTRON forecast subscriptions, pursuant to Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.

Buyer: The natural or legal person who enters the invoice details at the time of order. The Buyer's name or trade name, address, tax details and contact details appear in the order summary and on the invoice issued. The Buyer accepts that this information is correct.

02Subject of the contract

This contract governs the rights and obligations of the parties, pursuant to the provisions of Law No. 6502 on Consumer Protection (Tüketicinin Korunması Hakkında Kanun) and the Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği), in relation to the sale and performance of the digital service subscription (time-limited access to forecast products) that the Buyer orders electronically through the Seller's website.

The preliminary information part of this page is presented to the Buyer before the contract is concluded. The Buyer accepts that, before confirming the order, it has read and understood this information concerning the Seller's identity, the main characteristics of the service, the total price including taxes, the payment and performance terms and the right of withdrawal. The Terms of Use also apply to use of the service.

03Main characteristics of the service

  • Products: the day-ahead hourly forecast products selected by the Buyer in the order summary — system demand, licensed/unlicensed wind and solar generation, hydroelectric generation, the day-ahead market clearing price (PTF) and plant-level generation forecasts.
  • Scope: per product and per country; per plant for the plant-level forecast.
  • Term: the 1-, 6- or 12-month period selected in the order summary. The subscription ends automatically at the end of the period and is not renewed automatically.
  • Delivery channels: the web panel (app.megawattron.com), CSV/Excel downloads, REST API access with an API key and a daily e-mail report. There is no physical delivery.

04Price and payment

  • The prices shown on the site are exclusive of VAT. 20% VAT is added at the time of order, and the total price including taxes payable by the Buyer is shown in the order summary before the order is placed, together with its breakdown by product and period.
  • Payment is made by bank transfer only, to the Seller's bank account shown after the order has been created. Your unique reference code must be written in the payment description; the matching of payments without a reference code may be delayed. No card details are taken.
  • Fees charged by the Buyer's bank for the bank transfer are borne by the Buyer.
  • After the payment has been confirmed, the invoice is issued with the invoice details entered by the Buyer at the time of order and is sent electronically.

05Performance and commencement of the service

The service commences when the payment has been received in the Seller's account, matched to the reference code and confirmed. After confirmation, the Buyer's panel access is opened for the relevant products and the Buyer is informed of this by e-mail. This is generally completed within the business day on which the payment arrives and, for payments arriving late in the day or on a public holiday, on the next business day. The subscription term runs from the day on which access is opened.

If performance of the service becomes impossible, the Seller will notify the Buyer in writing or on a durable medium within 3 days of the date on which it becomes aware of this, and will refund the amount collected within 14 days of the date of notification at the latest.

06Right of withdrawal

There is no right of withdrawal for this service. The subscription is a service whose performance begins instantly, in electronic form, upon confirmation of payment.

Pursuant to Article 15/1-(ğ) of the Distance Contracts Regulation, the right of withdrawal cannot be exercised in contracts for services performed instantly in electronic form and for intangible goods delivered instantly to the consumer. As access to the forecast data is opened via the panel, downloads and the API at the moment the payment is confirmed, the subscription falls within this scope.

By ticking the confirmation box on the order page, the Buyer accepts that it requests that performance of the service begin instantly, in electronic form, upon confirmation of payment, and that it is aware that it therefore has no right of withdrawal.

07Buyers purchasing for commercial purposes

Where the Buyer is a merchant, company or other legal entity acting within the scope of its commercial or professional activities, the consumer-related provisions of Law No. 6502 and of the Distance Contracts Regulation do not apply. In that case the relationship between the parties is governed by the Terms of Use and the provisions of Turkish Code of Obligations No. 6098 and Turkish Commercial Code No. 6102; the price, payment and performance information on this page remains valid for information purposes.

08Complaints and objections

You may address your complaints about the order and the service in the first instance to info@megawattron.com or to the KEP (registered electronic mail) address —; applications are answered as soon as possible.

In the event of a dispute, a Buyer acting as a consumer may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) of its place of residence or of the place where the transaction was carried out (including via TÜBİS on the e-Devlet e-government portal), within the monetary limits announced each year by the Ministry of Trade (Ticaret Bakanlığı). For disputes exceeding that limit, the Consumer Court (Tüketici Mahkemesi) has jurisdiction; in the cases provided for by law, recourse to a mediator before bringing an action is a precondition for the action.

09Formation of the contract and entry into force

Before placing the order, the Buyer sees its cart, the period selected, the invoice details and the total price including taxes in the order summary and may correct them if necessary. The language of the contract is Turkish.

This contract is concluded and enters into force at the moment the Buyer ticks the confirmation box and places the order on the order page, the confirmation box stating that the Buyer has read and accepted the preliminary information form and this contract. The Seller sends the order details and the payment reference code to the Buyer's e-mail address; the current text of the contract can be accessed from this page at any time.
