01Parties and scope
These Terms of Use (the "Terms") govern the relationship between MEGAWATTRON ("MEGAWATTRON" or the "Company") and the natural or legal person (the "Customer") who uses the MEGAWATTRON website, the app.megawattron.com customer panel, the data download features, the REST API and the e-mail reports (together, the "Service").
By opening an account, using the Service or placing an order, you accept these Terms. If you are accepting on behalf of an organisation, you represent that you are authorised to bind that organisation. Purchases are additionally subject to the Distance Sales Agreement and Preliminary Information Form; the processing of personal data is explained in the KVKK Privacy Notice and the Privacy and Cookie Policy.
02Description of the Service
MEGAWATTRON produces day-ahead hourly forecasts for the electricity market: system demand, licensed and unlicensed wind and solar generation, hydroelectric generation, the day-ahead market clearing price (PTF) and plant-level generation forecasts. The forecasts are delivered via the web panel, CSV/Excel downloads, the REST API and a daily e-mail report. The products, countries and delivery channels offered may be extended or changed over time; during an ongoing subscription period, access to the product purchased will not be narrowed to the Customer's detriment.
03Account and security
- You must provide accurate and up-to-date information when opening an account and entering invoice details.
- Each account belongs to a single person. You must not share your sign-in details with others and must keep your password secure.
- The Customer is responsible for operations carried out through your account. If you notice any unauthorised use, you must report it to info@megawattron.com without delay.
- Demo accounts are granted for a limited period and scope; the Company reserves the right to extend or terminate demo access.
04Subscription and scope of access
- Subscriptions are per product and per country; the plant-level generation forecast is defined per plant. Access is opened only for the product, country and plant purchased.
- Subscription periods are 1, 6 or 12 months. Prices are shown exclusive of VAT; 20% VAT is added at the time of order.
- Payment is made by bank transfer, using the reference code given at the time of order. The subscription starts when the payment has been received in the Company's account and confirmed; the period runs from that date.
- The subscription ends automatically at the end of the period and is not renewed automatically. For uninterrupted access, a new order must be placed before the period ends.
- Price changes apply to new orders only; the price of a period already paid for is not changed afterwards.
- If the Customer stops using the Service part-way through a period, no refund is made for the unused time; rights arising from a material breach by the Company or from mandatory legislation are reserved.
05API usage rules
- API keys are specific to the user who created them and to the organisation to which that user belongs. They may not be shared with persons outside the organisation, nor placed in public code repositories or in client code running in the browser.
- A key is shown only once, when it is created. If you suspect that it has been leaked, you must revoke it in the API section of the panel and create a new one; until it is revoked, requests made with the key are deemed to be the Customer's.
- The API is provided on a fair-use basis and request limits (rate limits) apply. When a limit is exceeded, requests are temporarily rejected (HTTP 429). We recommend that you do not query the same data with unnecessary frequency and that you fetch it according to the publication times.
- Attempts to circumvent the security of the Service, to access other customers' data, to overload the system, to scrape the panel with automated tools or to reverse-engineer the software are prohibited.
- Backward-incompatible changes to the API are announced in advance wherever possible and with a reasonable transition period.
06Nature of the forecasts
The forecasts are produced with statistical and machine-learning models, relying on third-party sources such as data from the EPİAŞ Transparency Platform and weather forecast data. Delays, gaps or revisions in the source data, weather forecast errors, unusual market and grid conditions and changes in legislation may affect the forecasts. Forecasts may be updated after they are published.
The accuracy measurements published on the site and in the panel (e.g. WAPE) relate to the stated historical window; they do not guarantee future accuracy and do not constitute a commitment. The forecasts must not be relied upon as the sole basis for day-ahead market bids, balancing, generation scheduling, hedging or any trading decision. Making those decisions and bearing their consequences is the Customer's own responsibility.
07Intellectual property
The forecast data, models, software, panel, API, documentation and the MEGAWATTRON brand belong to the Company. The Customer is granted a non-exclusive, non-transferable and non-sublicensable right to use the forecasts in its own internal business processes, for the term of the subscription and limited to the scope purchased.
Without the Company's written permission, the Customer may not sell, rent or redistribute the forecast data to third parties, publish it publicly, or use it to develop a competing forecast product or model. Internal reports and analyses that are derived from the forecasts and do not contain the raw forecast data belong to the Customer.
The plant information the Customer enters into the system and the generation data it uploads remain the Customer's property; the Company uses them for the purpose of providing the Service and does not share them with third parties.
08Service continuity and maintenance
The Company exercises reasonable care to provide the Service without interruption and on time; however, uninterrupted access or a specific publication time is not guaranteed. Planned maintenance is announced in advance, wherever possible, via the panel or by e-mail. Outages of third parties such as EPİAŞ, meteorological providers and infrastructure providers, and events of force majeure, are beyond the Company's control. If a forecast cannot be published on time, the Company will give notice of this via the panel within a reasonable time.
09Limitation of liability
To the maximum extent permitted by law, the Company's total liability arising from the Service is limited to the subscription fee actually paid by the Customer for the relevant product in the 12 months preceding the event giving rise to the damage. The Company is not liable for loss of profit, imbalance costs, losses arising from market transactions, loss of data, loss of reputation or other indirect losses.
These limitations do not apply to damage arising from the Company's wilful misconduct or gross negligence (Article 115 of Turkish Code of Obligations No. 6098). The mandatory statutory rights of Customers acting as consumers are reserved.
10Termination and suspension
- The Company may suspend access or terminate the contract in the event of the sharing of an API key or account, the resale or publication of data, an attempted security breach or any other material breach of these Terms. To the extent the circumstances allow, it will first give written notice and allow a reasonable period for the breach to be remedied; in the case of serious breaches, access may be stopped without waiting for that period.
- Where termination is due to the Customer's breach, fees already paid are not refunded.
- The Customer may request closure of its account at any time; closure does not entail a refund for the period already paid for.
- When the contract ends, the API keys are revoked and panel access is closed. Records are retained for the periods stated in the KVKK Privacy Notice.
11Changes
The Company may update these Terms. Material changes to the Customer's detriment are notified to the e-mail address registered on the account, or via the panel, at least 15 days before they take effect. Changes do not alter, to the Customer's detriment, the price or scope of an ongoing subscription period that has been paid for. A Customer who does not accept a change has the right not to renew its subscription at the end of the current period; continuing to use the Service after the effective date is deemed acceptance of the change.
12Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Türkiye. In disputes with Customers acting as merchants or as public legal entities, the Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction pursuant to Article 17 of Code of Civil Procedure No. 6100. The rights of Customers acting as consumers to apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and the Consumer Courts (Tüketici Mahkemeleri) under Law No. 6502 on Consumer Protection are reserved.
13Contact and notices
For questions and notices concerning the Service, you can write to info@megawattron.com. The Company's notices to the Customer are sent to the e-mail address registered on the account or made via the panel. Between merchants, notices of default and termination falling within Article 18/3 of Turkish Commercial Code No. 6102 are given by the means prescribed by law (notary public, registered letter, telegram or registered electronic mail (KEP)).
